1. Acceptance of Terms

By accessing or using the services offered by BetterUs, you agree to be legally bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please discontinue use of the website and services.

2. Eligibility

• Services are available only to users who are 18 years of age or older.

• You confirm that you are legally competent to enter into a contract under the Indian Contract Act, 1872.

• You agree that you are not in a medical or psychological emergency requiring immediate in-person intervention.

3. Nature of Services

BetterUs offers virtual therapy services including:

• Individual therapy

• Couples therapy

• Sex therapy

Services are delivered only via secure video or audio platforms by licensed clinical psychologists and counselling professionals.

4. Booking & Payment

• Appointments must be booked through the BetterUs website.

• Payments are to be made in advance via UPI, using details provided on the site.

• Clients must use their own verified UPI ID and phone number.

• TOM does not issue session links without payment confirmation.

• Session links are generally sent 10 minutes prior to the scheduled time.

5. Cancellation & Refund Policy

• Cancellations are allowed up to 24 hours prior to the scheduled session without penalty.

• Cancellations or no-shows made within 24 hours of the scheduled session are non-refundable, regardless of reason.

• If the therapist cancels a session (e.g., therapist unavailability), a full refund or rescheduling option will be provided.

6. Confidentiality & Data Privacy

• All sessions are confidential and comply with the Mental Healthcare Act, 2017.

• Personal data is not shared without your consent, except when required by law (e.g., risk of harm to self or others).

• By using BetterUs services, you also agree to our Privacy Policy, which is an integral part of these Terms.

7. Disclaimer on Emergency Services

BetterUs does not provide emergency mental health services.
If you are experiencing any of the following, seek immediate help from emergency services or a hospital:

• Suicidal thoughts

• Psychotic symptoms

• Acute trauma or crisis

Helplines: iCall, Vandrevala Foundation, or nearest psychiatric emergency services.

8. Client Responsibility & Informed Consent

By availing BetterUs’s services, you acknowledge and agree that:

• Therapy may evoke distress as part of the healing process.

• You are responsible for participating honestly and consistently.

• Therapeutic outcomes are not guaranteed.

• You will not hold BetterUs liable for your personal decisions made during or after therapy.

9. Therapist Responsibility and Liability

• All therapists engaged by BetterUs are licensed and follow ethical, evidence-based practices.

• You agree not to hold BetterUs or its therapists liable for perceived lack of progress, unless there is proven professional negligence.

• Therapists may determine at their discretion that teletherapy is not suitable for you.

• The therapeutic relationship must remain professional: dual relationships, personal gifts, or unsolicited social media contact are not permitted.

10. Platform Use Restrictions

You agree not to:

• Impersonate others or provide false information

• Record sessions without explicit consent

• Upload malicious code or disrupt the platform

• Harass or intimidate therapists or TOM staff

• Use the platform for unlawful or non-therapeutic purposes

11. Intellectual Property

All content on www.theorangemind.com—including session formats, articles, branding, logos, and media—is the intellectual property of BetterUs. Unauthorized use or replication is prohibited.

12. Limitation of Liability

BetterUs acts as a facilitator connecting clients to independent professionals.
We are not liable for:

• Dissatisfaction with therapy outcomes

• Temporary platform interruptions

• Decisions made post-therapy

• Therapist unavailability or reassignment

Maximum liability, if any, shall be limited to the amount paid for the specific disputed session.

13. Service Modifications and Policy Updates

BetterUs reserves the right, at its sole discretion, to:

• Modify, suspend, or discontinue any aspect of its services (including pricing, therapist allocation, or features)

• Revise these Terms & Conditions or Privacy Policy at any time

Continued use after such changes constitutes your acceptance. It is your responsibility to review these Terms periodically.

14. Therapist Continuity and Allocation

While we strive to ensure continuity, BetterUs does not guarantee the availability of the same therapist over time. Reassignment may occur due to:

• Therapist availability

• Suitability assessment by the therapist

• End of a therapist’s engagement with BetterUs

• Any other operational reason

Reasonable efforts will be made to inform clients and offer alternatives.

15. Termination

BetterUs may terminate service if:

• A client breaches any term of this agreement

• Abusive, unethical, or unlawful behavior is observed

Clients may also discontinue services at any time, provided all dues are cleared.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be severed, and the remainder of the Terms will continue in full force and effect.

17. Jurisdiction & Governing Law

These Terms are governed by the laws of India.
All legal disputes shall be subject to the exclusive jurisdiction of courts located in Bangalore, Karnataka.
